Terms of Service

The agreement between you and Checkbase.

The short version.

  • · Checkbase is compliance software for Australian NDIS providers.
  • · You can use it if you're 18+ and authorised to bind your provider organisation.
  • · There's a 14-day free trial with a card on file. Cancel any time before it ends and you won't be charged.

  • · You own your data. You can export it at any time. We'll keep it for 30 days after cancellation so you can finish exporting.

Most of the above just says: we try to run the service well, you pay us, you can leave. The fine print below is there because Australian law requires it.

1. About these terms

These Terms of Service form a binding agreement between you (the customer organisation) and Checkbase Pty Ltd (ABN 23 697 668 330, ACN 697 668 330). .

2. Eligibility

You must be at least 18 years old and authorised to bind the organisation you're creating an account for. By signing up, you represent that you are. The organisation is the customer; individual users access the service on the organisation's behalf.

3. Your account

You agree to provide truthful information when signing up, keep your verification codes and email account secure, and keep your contact details current so we can reach you about service or billing matters. You're responsible for activity that happens under your accounts. Tell us promptly if you suspect unauthorised access by .

4. Subscription, trial and billing

Checkbase is offered on a subscription basis with monthly or annual billing. Each new customer gets a 14-day free trial with a payment method on file. If you cancel before the trial ends, you will not be charged. Otherwise, your subscription begins automatically at the end of the trial period at the tier you selected.

Subscriptions auto-renew at the end of each billing period. You can cancel any time from the settings page; cancellation takes effect at the end of your current billing period, and you won't be charged again. We will not unilaterally change the price of your subscription within a billing period. Where we change pricing for future periods, we will give at least 30 days' notice and you can cancel before any new price applies.

Promotional codes such as SIL2026 have specific terms that are shown at signup. They do not stack with other discounts unless we explicitly say so.

5. Acceptable use

You agree not to: scrape, reverse-engineer or attempt to copy the platform; share login credentials with anyone outside your organisation; upload content that's unlawful, infringing or malicious; or use Checkbase to circumvent obligations imposed on you by the NDIS Quality and Safeguards Commission or any other regulator.

6. Customer data

You own the customer data you put into Checkbase. We process it on your behalf to provide the service. A Data Processing Addendum (DPA) is available on request - .

We do not use your customer data - including participant or worker information - to train AI models, ours or anyone else's. We do not feed your customer data into third-party model providers.

7. Intellectual property

Checkbase owns all rights in the platform, including software, branding, designs and documentation. You own all rights in the content and data you upload. You grant us a limited licence to host, copy and process that content solely to provide the service to you.

8. Fees, payments and refunds

Fees are quoted and charged in Australian dollars. Payments are processed by Stripe. If a payment fails, we will retry and notify you; if the failure persists, we may suspend access until payment is resolved.

Refunds. If you cancel during your 14-day free trial you will not be charged. Outside the trial, we do not automatically provide pro-rata refunds for the unused portion of a billing period, but we will refund or credit you in good faith where:

  • You were charged after cancelling and we failed to honour your cancellation in time;
  • A material defect in the service prevented you from using it for an extended period;
  • A consumer guarantee under the Australian Consumer Law (ss 60-62) applies and a refund is the appropriate remedy.

To request a refund, and we will respond within 5 business days.

Annual subscriptions are charged up-front for 12 months. Cancellation stops auto-renewal; the unused portion of the current 12-month term is non-refundable except as set out above or where required by Australian law.

9. Service availability

We aim to keep Checkbase available on a best-effort basis and will work to address service issues promptly. Formal uptime SLAs are available on the Business tier and above. Nothing in this section excludes the consumer guarantees that apply to the supply of services under the Australian Consumer Law.

10. Termination

You can terminate your subscription at any time from the settings page. We can terminate this agreement on 30 days' written notice if a paid customer materially breaches these terms and does not cure the breach within that period, or if we cease offering the service. After termination, you will have 30 days to export your data before we delete or de-identify it in line with our Privacy Policy.

11. Liability

Where Checkbase fails to meet a consumer guarantee in the supply of services for which the right cannot be excluded under the Australian Consumer Law, our liability is limited (to the extent permitted by section 64A of the Australian Consumer Law) to the resupply of the services or the cost of resupply. To the maximum extent permitted by law, we exclude liability for indirect, incidental, special or consequential loss.

Nothing in these terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

12. Indemnities

You agree to indemnify Checkbase against losses arising from your unlawful use of the service, breach of these terms, or infringement of third-party rights through content you upload. We do not impose broad or open-ended indemnities on customers - this is the only indemnity you give us.

13. Privacy

How we collect, use and protect personal information is described in our Privacy Policy.

14. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email at least 30 days before they take effect. If you don't accept the change, you can cancel before it applies and your existing terms will continue until the end of your current billing period.

15. Governing law and disputes

These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. If a dispute arises, we agree to attempt to resolve it in good faith by direct discussion before commencing proceedings.
